Working with Shipt can be an exciting opportunity. Shipt affords workers the chance to deliver groceries and retail items to customers or to shop for customers at various grocery and retail stores. The flexibility, the freedom, and the income are part of the appeal for the many who have signed up to deliver or shop for Shipt.
Because its customers rely on Shipt for safe and reliable shopping and delivery, Shipt runs background checks on everyone who applies to work for Shipt. Shipt also runs periodic background checks on everyone who delivers and shops for Shipt. Whether it’s a delay in the Shipt background check time or an error in the Shipt background check, any sort of wrinkle that prohibits you from earning money is a problem. Being denied working with Shipt or being deactivated because of an error in your background check seems especially unfair. Unfair to you.
There are things you can do, and there are people you can call to fix that for you.
Understanding the Background Check Process
Shipt, like many companies in the gig economy whose success depends on safety and reliability, runs background checks on its drivers and shoppers. Shipt, like most companies, uses a third-party background check company to do these background checks. Shipts uses a company called Checkr. Checkr is tasked with:
- Verifying that all the information you provided Shipt on your application forms is true and accurate. This includes confirming employment and education.
- Scouring state, local, and federal criminal databases to find out if you have any criminal history that would disqualify you from working with Shipt.
- Reviewing your motor vehicle report to see if you have any driving infractions that would disqualify you from driving for or working with Shipt.
- Doing a credit check.
Checkr’s background checks for Shipt are thorough. Too often, they contain errors. Errors and inaccuracies can occur for several reasons:
- Any sort of misspelling or misplaced digits in your personally identifiable information (PII).
- The volume of names that Checkr must check can make Checkr move too quickly without using the degree of caution they should.
- Names can be similar.
- The internet and the databases that Checkr scours can contain mistakes.
Shipt will send you a pre-adverse action notice to let you know if there is a problem with your background check. This pre-adverse action notice likely means you are not eligible to work for Shipt. When Shipt sends you this pre-adverse action notice, they should also send you a copy of the background check report from Checkr. Review it. Review the background check report carefully. Look for errors. Look for crimes that you did not commit, adverse employment actions that did not happen, traffic infractions that you did not do, and anything else that might be wrong.
No matter how the error got into your background check or why, if you have been denied employment with Shipt or had your Shipt account or Shipt privileges deactivated, you know that you need to fix the error in order to keep making money. There is a way to fix the error, and Consumer Attorneys can help you do it.
Disputing Errors with the Background Check Company
If Shipt does not send you the background check report, you have the right to get it. A federal law called the Fair Credit Reporting Act (“FCRA”) gives you the right to receive a free copy of your background check report. The FCRA is also the law that contains the rules and regulations about the level of care that companies must use when they do background checks on people.
Once you have identified the error in your background check report, you will want to dispute it with the background check company and have them correct it. To do that:
- Consult with a consumer background check attorney. While it is possible to dispute an inaccurate Shipt background check report yourself, an attorney will be able to assess your case at the outset and determine what the best next steps might be.
- Collect information. You will need to collect all the documents necessary to prove that the error on the Shipt background check report is an error.
- Listen to your attorney. Your attorney may advise you to file your dispute with Checkr. We advise that you file the dispute via the U.S. mail instead of online. Disputing online might cause you to lose your right to sue. Under the FCRA Checkr will have 30 days to reply to your dispute. If they do not do this – or if the error and the damage from the error were significant enough to begin with – then legal action might be inevitable.
Why an Experienced Attorney is Crucial
An experienced consumer background check attorney will help you in many ways. Among them:
- Legal expertise. Consumer Attorneys understand the legal landscape of background checks. They understand the FCRA and other laws that give you the rights you have as a worker. You have rights. Sometimes, you just need an attorney to let you know what those rights are.
- Communication. Sometimes, companies listen to attorneys more closely than they do to their customers. Background check attorneys can communicate with these companies using their language and with assertiveness. If the goal is to get you back up and running with Shipt, we can communicate that.
- Legal action. Some situations warrant legal action. Shipt and Checkr know the importance of time. So do we. So why waste any? As soon as you receive notice from Shipt of their rejection, give Consumer Attorneys a call.
- Gathering evidence. Attorneys will help you gather the evidence you need and prepare the best strategy to prove your case.
- Protecting your rights. We can make sure that your rights are upheld and preserved for the future. That will include fixing the error on your background check, getting you reinstated at Shipt, and holding Checkr accountable for their error and what that error cost you.
Getting word that you have been rejected from driving for, shopping for, or delivering for Shipt can be devastating. We understand that. We understand what a few days, a few weeks, or a few months of diminished income can do to people. We also understand how to fix background check errors with Shipt. Sometimes, the process is smooth, and sometimes, the process requires some legal action and legal action. We are prepared for all of it. Give us a call and tell us your Shipt story.
